Judge rules ‘Hatupangwingwi’ no longer a Hate Phrase

A kenyan court on Thursday, July 14 ruled that the phrases ‘Hatupangwingwi’ by Exray of Black Market Records and ‘Watajua Hawajui” to no longer be considered hate speech. Justice Anthony Ndung’u corrected the decision that was made by NCIC to term the two phrases as hate speech.

Justice Ndung’u reported that the two phrases were not to be considered hate speech according to the decision that was made by NCIC on April 8, 2022. The judge insisted that he was quashing the ruling that was made.

This decision came after a group of lawyers moved to court to challenge the decision that was made by the NCIC early this year. They argued that the rule would affect millions of Kenyans who used the terms on a daily basis.

The lawyers claimed that the move to ban the phrases was an abuse of state power. They argued that Kenyans had familiarized themselves with the phrases from popular local songs.
